NEW BRUNSWICK
REGULATION 2015-6
under the
Fish and Wildlife Act
(O.C. 2015-40)

Section 2 of New Brunswick Regulation 94-47 under the Fish and Wildlife Act is amended by repealing the following definitions:
“New Brunswick Medicare card”;
“New Brunswick Medicare number”.

Section 4 of the Regulation is amended
(
a
)
in subsection (1)
(i
)
by striking out the portion preceding paragraph (a) and substituting the following:

(1)
Subject to subsection 82.1(1) of the Act, an application for a resident moose licence may be made by a resident
(ii
)
in paragraph (a) by adding “and” at the end of the paragraph;
(iii
)
by repealing paragraph (b);
(
b
)
by adding after subsection (1) the following:

(1.1)
Despite paragraph 4(1)(
c
), a resident who was born in the Province and who is a member of the Canadian Forces or the Royal Canadian Mounted Police whose principal place of residence is outside the Province may apply for a resident moose licence.
(
c
)
by repealing subsection (2) and substituting the following:

(2)
An application for a resident moose licence may be made
(
a
)
by using a computer assisted application line from a touch tone telephone,
(
b
)
by completing an electronic application accessible through the Department’s website or Service New Brunswick’s website,
(
c
)
at a Service New Brunswick centre, or
(
d
)
at the business premises of a vendor appointed under section 84 of the Act.
(
d
)
by repealing subsection (3) and substituting the following:

(3)
An applicant for a resident moose licence shall pay a non-refundable application fee of $6.30.

Subsection 4.1(1) of the Regulation is amended by striking out “or 7(1)”.

Section 6 of the Regulation is repealed and the following is substituted:

An applicant for a resident moose licence shall indicate from among the wildlife management zones for which a quota has been established by the Minister under section 5 the one wildlife management zone in which the applicant wishes to hunt moose.

Section 7 of the Regulation is repealed.

Section 8 of the Regulation is repealed.

Section 9 of the Regulation is amended
(
a
)
in subsection (1)
(i
)
in paragraph (b)
(A
)
by striking out “completed on the Department’s website” and substituting
“accessed through the Department’s website or Service New Brunswick’s website”
;
(B
)
in the English version by striking out “and” at the end of the paragraph;
(ii
)
by repealing paragraph (c) and substituting the following:
(
c
)
in the case of an application made at a Service New Brunswick centre, the end of the business day for that Service New Brunswick centre of the second Friday of the month of June in the year of the application, and
(iii
)
by adding after paragraph (c) the following:
(
d
)
in the case of an application made at the business premises of a vendor appointed under section 84 of the Act, the end of the business day for that business premises or midnight, whichever occurs first, of the second Friday of the month of June in the year of the application.
(
b
)
in subsection (3) by striking out “incomplete, inaccurate, misleading, illegible or indiscernible” and substituting
“incomplete, inaccurate or misleading”
.

Section 10 of the Regulation is amended
(
a
)
in subsection (1) by striking out “at any office of the Department or of Service New Brunswick at which resident moose licences are sold” and substituting
“at any Service New Brunswick centre”
;
(
b
)
in subsection (2)
(i
)
by repealing paragraph (a) and substituting the following:
(
a
)
provides the unique identification number provided under subsection 82.1(4) of the Act to the applicant at the time of his or her registration under section 82.1 of the Act or satisfies the Minister as to the applicant’s identity by presenting any identification and other documentation requested by the Minister,
(ii
)
by repealing paragraph (b);
(
c
)
in paragraph (3)(a) by striking out “an office of Service New Brunswick where those licences are issued” and substituting
“any Service New Brunswick centre”
;
(
d
)
in paragraph (3.1)(a) by striking out “an office of Service New Brunswick where those licences are issued” and substituting
“any Service New Brunswick centre”
.

Section 10.1 of the Regulation is amended
(
a
)
in subsection (1) by striking out “(1.2),”;
(
b
)
by repealing paragraph (1.1)(b);
(
c
)
by repealing subsection (1.2);
(
d
)
in subsection (1.3) by striking out “paragraphs (1.1)(b) and (c)” and substituting
“paragraph (1.1)(

(

by repealing paragraph (2)(a);
(

in paragraph (3)(b) by striking out “(3.2),”;
(

)
by repealing paragraph (3.1)(b);
(

)
by repealing subsection (3.2);
(

in subsection (3.21) by striking out “paragraphs (3.1)(b) and (c)” and substituting
“paragraph (3.1)(

)”
;
(

)
by repealing paragraph (3.3)(a).

Subsection 12(2) of the Regulation is amended by striking out “paragraph 6(a) or 10(3)(b)” and substituting
“section 6 or paragraph 10(3)(
b
)”
.

This Regulation comes into force on April 18, 2015.
